Restraint Bypassed on Bill


In 2010, legislation to amend the use of restraint and seclusion in schools fell through.  Democratic Sen. Tom Harkin wanted to focus on that topic in regards to the No Child Left Behind Law.  However, the issue of restraint and seclusion was bypassed when discussing the reimplementation of the law recently.


Harkin wants to include amendments on restraint and seclusion when discussing the law in the Senate.  He feels that too many students with physical/mental challenges have passed away due to restraint and seclusion.  He adds that staff members have developed physical, psychological, and emotional stress based on this practice.  Activists agree with Harkin’s viewpoint.


“It was disappointing that it wasn’t included in the base bill,” said Barb Trader, who’s been working for nearly two years to secure federal legislation that would limit the use of restraint and seclusion in schools as head of a coalition of 22 national disability groups known as APRAIS.


A series of reports have showcased the abusive and deadly uses of restraint and seclusion.  These reports have been authored by activists.   If these types of laws are passed regulating restraint and seclusion, it would signify the first time federal government would oversee this practice.  Presently, laws on restraint and seclusion are implemented by a series of state regulations.

"Lives Worth Living" Documents Rights

 “Lives Worth Living” is a historical documentary of the physically/mentally challenged movement in the US.    The documentary highlights how through legal battles and protests, people with physical/mental challenges overcame various barriers.  These barriers included denial of access to schools and public transportation.


The documentary also tells the story of Fred Fay.  Fay was diagnosed with a spinal cord injury.  He was an activist for many years for physically/mentally challenged rights, and he passed away in August.  The documentary is in his memory.


At the conclusion of “Lives Worth Living”, the documentary showcased the signing of the Americans With Disabilities Act.   (ADA).  The ADA has been known as one of the most influential documents in civil rights legislation.  The thousands of people that united to make it a law showed that with determination anything is possible as seen in the film.


As one reviewer of “Lives Worth Living” states, “It’s not about rights and access anymore.  It’s about opportunity and support.  People with physical/mental challenges have been farmed out of the systems as communities stay in the dark. “This documentary hopes to change that perspective.   “Lives Worth Living” airs at various days and times on PBS.



“Vive vale la pena vivir"derechos de documentos

Bloomberg Comments on NYC Taxis

Mayor of New York City Michael Bloomberg stated that accommodating all taxis to be accessible in the city would be problematic.  The taxis are pricy and bumpy, and there’s lots of space between passenger and driver.  His remarks were stated in a recent interview.

“The suspension is a lot worse and it’s harder to get up to pay the cab driver and get in and out and that sort of thing,” Bloomberg said. “Fewer people may use cabs because the suspension is worse. I think you’re going to see (law)suits about people getting up trying to get across the divide — there’s so much more space between the backseat and the divider. I think you’re going to see people getting hurt.”

 His remarks come in regards to the city being sued over accessible taxis.  There are only 232 accessible cabs presently.  In the early part of the year, activists were responsible for the lawsuit.

Bloomberg also states that accessible taxis aren’t what people in wheelchairs want or need.  He feels they are dangerous and uncomfortable.  Bloomberg fears the result would be less people using taxis.

SSI Payments to Rise

In 2012, Supplemental Security Income (SSI) money will rise by 3.6%.  The changes will occur starting December 30, 2011.  Over 8 million people who receive the money will be affected by these changes.

The payments for a single person with a physical/mental challenge will rise from $674 to $698.  For a couple receiving money, it will rise from $1,011 to $1,048.  The money is received in monthly installments.

The figures are changing due to COLA.  COLA is an acronym for cost-of-living adjustment.  The COLA for SSI payments changes when inflation grows.

COLA started being tracked in 1975.  2010 and 2011 were the only years that payments didn’t rise since 1975.  This is the first time SSI money has increased since 2009.
